1. Definitions
- “Agency,” “we,” “us,” “our” refers to D’Palawan Travel and Tours.
- “Site” refers to this website and all content, tools, pages, posts, features, embedded forms, inquiry links, and related communications made available through it.
- “Client,” “you,” “your” refers to any visitor, user, browser, customer, or person accessing the Site, including anyone who inquires, reserves, books, pays, or participates in any travel-related arrangement coordinated through the Agency, including group members.
- “Providers,” “Suppliers,” “Independent Providers” refers to third parties that own, operate, manage, supervise, or deliver services (e.g., hotels, transport companies, drivers, boat operators, tour operators, guides, rental suppliers, equipment owners, venues, attractions, and other third parties, including “private owners” where applicable).
- “Services” refers to travel-related arrangements that may be coordinated through the Agency, including tours, transfers, rentals, accommodations, permits, entrance fees, and related add-ons. Services are primarily governed by our Terms of Service and relevant service-specific waivers/disclaimers.
- “Site Policies” refers to the legal pages published on this Site and incorporated into these Terms by reference, including (without limitation) our Terms of Service, Privacy Policy, Disclaimer, Disclosure, and Refund Policy (see more below).
- “Official Channels” refers to our official communications as listed on the Site (which may include email and official messaging accounts/pages). For avoidance of doubt, messages sent through unofficial profiles, fake pages, or third-party accounts are not considered Official Channels.

Electronic acceptance is binding: To the fullest extent permitted by law, electronic confirmations, booking records, payment records, screenshots, and communications made through Official Channels may constitute valid evidence of consent and agreement, with the same effect as a physical signature.
Do not proceed if you do not fully agree to any and all provisions stated in these Terms and the Site Policies. Your sole remedy, if you disagree with any part, is to stop using the Site and refrain from availing any services, products, packages, bookings, or referrals through the Agency.
3. Conflicts, Clarifications, and Application of Policies
Travel arrangements often involve multiple documents: Site Policies, Provider rules, booking confirmations, and service-specific waivers/disclaimers. If any provision across these appears vague, ambiguous, inconsistent, or conflicting, you agree to contact us and seek clarification before you proceed with a booking, deposit, or travel.
Order of practical application: For coordination clarity (and to minimize misunderstandings), the following usually controls, depending on the issue:
- For Site usage issues (content, tools, access, links, submissions): these Terms of Use control.
- For booking/service issues (tours, transfers, rentals, scheduling, payments): the Terms of Service, Provider rules, and booking confirmation control.
- For cancellations/refunds: the Refund Policy and any stricter Provider rules control.
- For privacy/data handling: the Privacy Policy controls.
Fairness and legal limits: The Agency may provide written clarifications to explain how policies apply to a specific situation for coordination and documentation purposes. However, nothing in this clause is intended to unlawfully waive rights that cannot be waived under applicable Philippine law (including mandatory consumer protection standards).
4. Eligibility and Responsible Use
- Legal capacity: By using this Site and/or attempting to book services, you confirm you are of legal age in your jurisdiction and have the legal capacity to form a binding agreement.
- Minors: Minors may browse for general information. Bookings, payments, and acceptances must be made by a parent/guardian or legal adult. If you book on behalf of a minor or a group, you represent you have authority to do so and accept responsibility for ensuring all participants comply with applicable laws, safety instructions, Provider rules, and Site Policies.
- Lawful use: You agree to use the Site only for lawful purposes and not to misuse, disrupt, scrape, reverse engineer, hack, introduce malware, attempt unauthorized access, or interfere with Site operations.
- Accountability for actions: You are responsible for your device security (including passwords and access to your email/messaging apps). You are responsible for activities carried out through your device, accounts, or communications when interacting with the Agency.
5. Purpose of the Site and the Agency’s Role (Facilitator Only)
This Site provides travel-related information, destination guides, blog posts, sample itineraries, and booking coordination features intended to help travelers plan trips, compare options, and connect with independent Providers.
D’Palawan Travel and Tours is a travel/booking agency and not a tour operator, transport operator, accommodation operator, rental operator, vessel/vehicle owner, employer of drivers/crew, or equipment owner—unless explicitly stated in writing on an official booking confirmation.
Operational control and performance belong to the Provider. This includes licensing, staffing, equipment condition, inspections, maintenance, safety management, route decisions, on-the-ground execution, and compliance with operational rules and directives (including directives from port authorities, tourism offices, protected-area management offices, and other government agencies).
No carrier / no insurer: Unless explicitly stated in writing, the Agency is not a carrier, operator, vessel owner, fleet manager, insurer, or guarantor of any service outcome, schedule, safety result, or uninterrupted travel experience.
6. Travel Details Change Frequently (Dynamic Conditions)
Travel conditions can change quickly and without warning. Information shown on this Site may be affected by weather and sea state, tides, local regulations, site capacity limits, port authority directives, road conditions, security checkpoints, Provider availability, seasonal adjustments, environmental closures, protected-area rules, and operational decisions by Providers.
These changes may occur before or during your travel dates. Even minor shifts can affect safety decisions, departure windows, meeting points, and pickup/drop-off locations. You agree to maintain reasonable flexibility and to plan buffer time for connections and time-sensitive schedules.
7. Best-Effort Updates; No Guarantee of Completeness or Accuracy
We make good-faith efforts to keep Site content current and useful. However, we do not guarantee that all information on the Site is complete, accurate, verified, or up to date at all times.
Accordingly, any reliance on Site content is at your own discretion and risk, and you agree that the Agency shall not be liable for losses, inconvenience, missed connections, additional costs, delays, or damages arising from reliance on information that later becomes outdated, incomplete, changed by authorities, or modified by Provider operational decisions.

All Site content is subject to change without prior notice, including (without limitation) pricing references, schedules, time estimates, itinerary descriptions, inclusions/exclusions, pickup points, safety notes, and Provider availability.
We may update, remove, replace, or reorganize pages, posts, and information at any time. The controlling details for any service are those confirmed at booking and/or issued by the responsible Provider for actual operations.
9. Independent Verification Required
You are responsible for verifying critical information with appropriate sources prior to making decisions or finalizing plans. This includes (but is not limited to):
- Pricing: total cost, surcharges, deposits, security deposits, port/entrance/environmental fees, permit fees, peak-season adjustments, and add-ons;
- Schedules and durations: pickup times, departure windows, weather holds, check-in cutoffs, waiting-time rules, and recommended buffers;
- Distances and routes: realistic travel time estimates, road/sea conditions, feasible pickup points, and accessibility limits;
- Rules and requirements: manifests, identification requirements, protected-area rules, age/health restrictions, baggage or weight limits, and operator policies.
We strongly encourage you to confirm key details through official advisories, local authorities (where applicable), and/or directly with the responsible Provider—especially for connecting flights, multi-leg itineraries, remote destinations, and weather-dependent activities.
10. Photos, Images, and Media Disclaimer
Photos, videos, and other media displayed on the Site are for general presentation and reference only. Actual conditions may differ. Visual differences may result from camera angle, lighting, weather, seasonality, editing, compression, file formats, pixel density, screen resolution, device settings, and other technical or environmental factors.
You agree that the Agency is not responsible for perceived differences between Site media and actual conditions on the ground, including differences in accommodation appearance, vessel/vehicle assignment, equipment, beaches, water clarity, and weather.
11. Packages, Inclusions, and Substitutions May Vary by Provider
The Site may describe packages, inclusions, itineraries, and “what’s included” items. However, inclusions, service scope, equipment, vehicle/vessel assignments, staffing, and operational standards may differ by Provider and may change due to availability, safety considerations, official directives, environmental rules, or Provider policy updates.
Final and controlling inclusions/exclusions are those confirmed at booking and/or provided by the responsible Provider. If there is any discrepancy, the Provider’s final confirmation and actual operational constraints will govern.
Substitutions and safety decisions: Providers may substitute routes, departure points, stops, schedules, or components to protect passenger safety, comply with regulations, protect the environment, or respond to capacity limits. Such substitutions do not automatically create a refund right unless the applicable Provider policy and/or the Site’s Refund Policy provides otherwise.
12. Blog Posts and Destination Articles for General Reference Only
Blog articles, destination guides, itineraries, and travel experience posts published on this Site are provided for general informational purposes only. They are not guarantees, warranties, professional advice, or official advisories.
Content should not be treated as a substitute for direct verification with competent authorities or Providers—especially for safety, regulatory compliance, medical preparedness, and time-critical logistics.
13. Third-Party Links, Tools, and External Platforms
This Site may include links to third-party websites, payment platforms, booking tools, map services, social media pages, or Provider pages. Such links are provided for convenience only and do not constitute endorsement, warranty, or guarantee of any third party’s content, services, safety, legality, licensing, insurance, or performance.

14. User Submissions, Inquiries, and Communications
If you submit inquiries, messages, reviews, photos, videos, documents, or other content to the Agency (including via forms, chat, email, or messaging platforms), you represent that your submission is truthful, lawful, and does not infringe the rights of others.
Record-keeping and evidence: For coordination, compliance, and dispute-resolution purposes, the Agency may keep communications and timestamped records to document itinerary changes, approvals, cancellations, disputes, confirmations, and operational notices, subject to the Privacy Policy.
No emergency channel: The Site and our messaging channels are not guaranteed to be monitored 24/7. If you face a medical or safety emergency, contact local emergency services and/or the relevant authority immediately.
15. Prohibited Content and Prohibited Conduct
You agree not to:
- submit false, misleading, fraudulent, or abusive inquiries or claims;
- post or transmit content that is unlawful, defamatory, harassing, threatening, or invasive of privacy;

Where liability cannot be excluded under applicable law, the Agency’s liability shall be limited to the maximum extent permitted by law.
19. Indemnification
You agree to defend, indemnify, and hold harmless the Agency, its owners, directors, officers, employees, agents, and affiliates from and against any claims, damages, liabilities, losses, costs, and expenses (including attorney’s fees) arising from: (a) your misuse of the Site; (b) your violation of these Terms or any Site Policy; (c) your violation of any law or third-party rights; or (d) your submissions, communications, or conduct connected to your use of the Site.
20. Consumer Protection and Non-Waivable Rights
Nothing in these Terms is intended to unlawfully limit or waive rights that cannot be waived under applicable Philippine law (including mandatory consumer protection standards). If any provision is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.
