This Disclosure explains: (1) who we are; (2) how our website and business operations may generate revenue; (3) the nature of our commercial, referral, advertising, or affiliate relationships; and (4) the important limits of responsibility where services are performed by independent third-party providers.

This Disclosure is intended to help travelers clearly understand what content on our Site is informational, what may be commercial, and how that distinction affects decision-making. 1. Acceptance of Disclosure and Incorporation by Reference

By making a reservation, submitting payment, paying any deposit, signing any waiver, clicking “I agree,” replying “Confirmed,” “Agree,” or “Yes,” or otherwise availing services of third parties through the Agency, the client (“Client” or “Renter”) acknowledges that they have read, understood, and agreed to this Disclosure, together with this Site’s Terms of Service, Terms of Use, Privacy Policy, Disclaimer, and Refund Policy (collectively, the “Site Policies”), all of which are incorporated herein by reference.

If any provision across the Site Policies appears unclear, inconsistent, or ambiguous, the Client agrees to contact the Agency for clarification before making any payment or availing any service. To the fullest extent permitted by law, the Agency may provide written interpretation for coordination and documentation purposes. Nothing in this Disclosure is intended to unlawfully waive consumer rights that cannot be waived under applicable Philippine law.

2. Who We Are

D’Palawan Travel and Tours is a travel coordination and booking agency that assists Clients in finding, comparing, and arranging travel-related services in Palawan and nearby destinations. Depending on the Client’s request, this may include (without limitation) tours and activities, boat transfers, land transfers, motorbike rentals, accommodations, permits, entrance fees, and other travel components (collectively, the “Services”).

D’PALAWAN TRAVEL AND TOURS IS A TRAVEL/BOOKING AGENCY AND NOT A TOUR OPERATOR, TRANSPORT OPERATOR, RENTAL OPERATOR, OR DIRECT SERVICE PROVIDER. Unless expressly stated in writing on an official booking confirmation, all operational services are performed by independent third-party providers and remain under their ownership, management, and control.

3. Independent Providers and Service Delivery (Key Disclosure)

Most travel services featured on our Site or arranged through our coordination are provided by independent third parties, including but not limited to hotels, transport companies, boat operators, vehicle or motorbike owners, rental suppliers, guides, venues, and tour operators (collectively, “Providers”).

While the Agency may exercise reasonable care in coordination, communication, and documentation, each Service is ultimately owned, staffed, equipped, supervised, and operated by the Provider. Providers determine operational matters such as safety protocols, crew or driver assignments, equipment condition, maintenance schedules, route selection, weight limits, boarding cutoffs, weather holds, and compliance with government directives.

Accordingly, the Agency is not the operator and does not control operational performance. The Agency shall not be liable for any injury, loss, delay, cancellation, overbooking, non-performance, safety incident, or other outcome arising from the acts or omissions of Providers, private owners, or other third parties.

Direct claims with Providers: Where an issue relates to a Provider’s performance (including service quality, cancellations, safety incidents, staff conduct, or equipment condition), the primary claim generally lies with the Provider and is subject to the Provider’s own policies, documentation requirements, timelines, and applicable waivers. The Agency may assist in relaying communications as a courtesy but does not guarantee outcomes.

4. The Agency’s Facilitator-Only Role

To avoid confusion, it is important to distinguish between a booking facilitator and a service operator:

  • What we do: We help Clients compare options, request quotations, communicate schedules and headcounts, coordinate pickup points, relay Provider requirements, and assist with booking confirmations and logistics.
  • What we do not do: We do not operate vessels or vehicles, employ Provider staff, maintain equipment, supervise daily operations, or guarantee service outcomes unless expressly stated in writing.
  • What we cannot control: Weather conditions, sea state, port authority directives, road access, site closures, staffing availability, capacity limits, or Provider operational decisions.

This distinction helps travelers assess risk appropriately, plan time buffers, ask informed questions, and arrange suitable personal insurance coverage.

5. How We May Earn Revenue

This website and the Agency’s operations may generate revenue through one or more of the following methods. These revenue streams help support staffing, communication costs, booking coordination, customer support, website hosting, content creation, software tools, and platform maintenance.

  • Coordination or facilitation fees: In some cases, the Agency may charge a coordination, processing, or handling fee—particularly for complex itineraries, multi-provider arrangements, remote destinations, or non-standard logistics. When applicable, we use reasonable efforts to disclose such fees prior to payment.
  • Provider commissions or referral fees: The Agency may receive commissions, margins, or referral incentives from certain Providers when a booking is completed. In many cases, this does not increase the price paid by the Client. However, pricing structures vary, and the Agency does not guarantee that commission-based arrangements always reflect the lowest possible price.
  • Advertising: The Site may display third-party advertisements, including those served by ad networks. Ad placement may be automated, and we do not control all ads shown at all times.

No promise of free service: Travel coordination involves real costs. Some bookings may include Agency fees or embedded Provider commissions. Clients are encouraged to request clarification before payment if a cost breakdown is needed.

6. Affiliate and Referral Links

Some links on this Site may be affiliate or referral links. If you click such a link and later complete a booking or purchase, the Agency may receive a commission or referral fee. This helps support our website and coordination services.

No lowest-price guarantee: Affiliate or referral links do not guarantee the lowest available price or identical inclusions. Pricing, cancellation terms, and add-ons may vary depending on platform, Provider, season, or booking method.

  • licensing or insurance status at all times;

Providers are independent third parties. Clients are responsible for conducting appropriate due diligence and confirming details prior to travel.

10. Limitation of Liability Relating to Disclosure Matters

To the fullest extent permitted by law, the Agency shall not be liable for any loss or damages—whether direct, indirect, incidental, special, consequential, or punitive—arising from or related to:

  • use of or reliance on informational content on this Site;
  • advertisements, affiliate links, referral links, or third-party offers;
  • communications or transactions between the Client and any Provider or third party;
  • the performance or non-performance of any Provider or private owner; or
  • events beyond the Agency’s operational control, including weather events, port closures, environmental restrictions, and official directives.

Where liability cannot be excluded under applicable law, any liability of the Agency shall be limited to the maximum extent permitted by law and, where applicable, limited to the amount actually received by the Agency for its facilitation services (excluding amounts paid to Providers), if any.
